Can i travel abroad with false criminal cases pending in court of law.

My brother in law wife has falsely accused him, myself and other family members in attempt to murder case and filed a false FIR against all of us. My question is can i travel abroad for work related things and stay for 2-3 years without coming back to India with this pending case, there is not charge-sheet filed yet.

You cannot decide and say that those are false cases. Unless Court decides and gives a finding they cannot be false cases. Since charge sheet is not filed and no condition is on you by any Court restraining you to visit Abroad so you can go to Abroad and reside their safely till the cases are over.

1. You may need to appear court on each hearing dates. After chargesheet filed, the case would move to trail stage.
2. As the chargesheet is not filed yet, you may approach high court to quash the case ( if you have sufficient grounds to get this case quashed ).
3. If you leave country for 2-3 years there may warrant issused and your passport can be revoked.
