Can I file case under ipc 420 and ipc 406 , for not refunding my money

I took some goods from a renter in the year May 2020 for my business, but due to corona , i send back his goods within 3 days, and he assured me to refund money after deducting some amount , but still date i didn't get anything...the sum was 60 thousand rupees.
For proof i have bill ( but with out GST) as well as many call recoding where i asked him for money , and he assured me to refund it , but never ever did that .
Any other way to get back the money let me know

You can send him a legal notice demanding your outstanding money and telling him that if you didn’t pay the money you will be prosecuted as per law.
