Can I be arrested for accepting crime

12-Jun-2023 (In Criminal Law)
Mr X who is from SC community did fraud with me and took some money from me. I went to his home to ask money where he and his family misbehaved with me. The had SC/ST act case registered on me and I had IPC 354 and 420 case registered against Mr X and family. The SC/ST act case done upon me got closed as it was complaint case and Mr X didn't pushed. Now in my IPC 354 case I have deposed before magistrate under crpc 164 where I have accepted to used derogatory words against Mr X. Now can Mr X use my statement given under crpc164 against me and how?

Yes…Mr. X can use your statement that you have given before the court. But since Mr. X was not serious in his previous complaint case which got closed that can be a plus point for you and you can always convince the court if he files something against you that he had taken money from you and that’s why you used derogatory words. For more legal assistance I am just a call away.

Evidentiary value of statement made under section 164 CRPC
Any confession made under the section is a weak evidence and hence needs to be corroborated.
it may be used to corroborate or contradict a statement made in the court in the manner provided under section 157 and 145 of Indian evidence act.
the statement cannot be used as a substantive piece of evidence but it can be used for the purpose of corroboration and can be used to contradict by cross examination the person who made it.

yes, giving statement before magistrate confirm your crime. statement is valid and is enough to get you punished. However, the contents of statement are also required to be looked into to ascertain the fact.
