Can fake company bid for tenders

I am member of vengitangu grama panchayth, and the panchayth didnt followed tender procedure correctly for making 7 office counters but 3 companies were placed the bid ,but in that 2 companies were fake ,so my question is whether the company who won the tender got any pecuniary advantage even if sold the item for market price

no, a fake company cannot bid for tenders. If prima facie it is found that the Vengitangu Gram Panchayath has not followed the tender procedure correctly for making 7 office counters, wherein two fake companies were allowed to participate then you can approach the Court of Hon'ble judicial First Class Magistrate and get the tender struck down by the court and in such an event the court will direct the Panchayath authorities to call for a fresh tender. While approaching the court you will have to make sure that you submit ample evidence proving that the two companies were fake.
Your question whether the company which had won the tender get any pecuniary advantage does not arise if the Panchayath is directed to call for fresh tender. On the other hand if the court finds the tender procedure is correctly followed then any pecuniary advantage received by the company which had won the tender cannot be questioned.

Hi,
If the Fake company full fill all conditions to participate in bid Nothing can be done ,They can sub contract ti to any one ,They can make pecuniary advantage, You can verify the company is having fulfilled all legal formalities ,If not you can try to cancel bid /auction
