can defendant access to e-file submissions without making appearance

28-Jun-2025 (In Criminal Law)
I am defendant, but not summoned. I do not want to make official appearance because my presence not required. I need know whether I can register for e-file in my case and see all e-file submissions made by complainant because my contact details not in court yet. If not, can I register for e-file with court permission without making appearance in my matter.

Unless you are arrayed as an accused or summoned by court, you may not get access to e-filing updates. However, you can file an application through counsel seeking court’s permission to register for e-filing. However this depends on which court the matter is pending. Furthermore in a criminal matter it is very important to mark appearance once summons is served

Well, you do not e file your Defence Statement if you have not been summoned until now, however, you can access and get Certified Copies or Virtual files of the Petition/Plaint filed by the Plaint/Petitioner against you in Court via E-filing.

As a defendant not yet summoned and whose contact details are not on record, you cannot access the e-filing portal or case documents directly unless you're officially a party on record. To view e-filings: You may authorize an advocate to appear and file a vakalatnama or intervene with court permission to access filings. Without making a personal appearance, your lawyer can request limited access or inspection from the court. Court permission is needed to access e-file records before formal service/summons. In short: You need court's permission or a lawyer's intervention to access e-filings without making an official appearance.

The simple answer to your question is NO. Until the appearance is made you will not be given online access to the case portal. The simple answer to your question is NO. Until the appearance is made you will not be given online access to the case portal.
