Can blank paper signed forcefully used against me
14-Jun-2023 (In Criminal Law)
After some arguments with my husband i left him with my son and came back to India. I was living with my husband in USA. While leaving, he forcefully took away my passport and forced me to write and sign on plain paper. He forced me to write that " I am taking my son without his consent. I have torchered him mentally and I would be filing for divorce". Can he use these papers to get divorce and child custody?
You say that your husband took away your passport forcefully. then how did you come back to India without having a passport? you further say that he got signed blank papers but your later statement says otherwise.
however, as far as Indian Law is concerned, any thing written out of court is of no consequence if the same is got done forcefully and free will and is also not told before a Court of law.
you can get sent a legal notice to your husband asking him not to use the same as it was got written forcefully.
he cannot seek divorce on the basis of these document in India.
