Can a withdrawn FIR be reopened after mutual agreement

19-Sep-2024 (In Criminal Law)
My ex gf filed a FIR of a false case to me, it was false promise of marriage, after that she has taken back the complaints and we were asked to submit an affidavit saying she filed a fir because she was angry that i don’t want to marry her and we will get married soon, but I don’t want to be with her anymore she is a toxic woman and she cheated on me it’s just I don’t have the evidence to prove it. can she reopen this case again or file another fir later if i refused to marry her?

Since your ex has withdrawn the false FIR and submitted an affidavit, reopening the case on the same grounds is unlikely. However, she could file a new complaint, but it would be scrutinized, especially with her prior admission. To protect yourself, document all communications and formally refuse the marriage.

FIR cannot be reopened but a fesh FIR can be filed in which the reference of the old one can be given. in case of any physical intimacy the fresh FIR can also mention the case for Rape..Just telling you because same type of case is being handled by me since too long...So I can understand the problem

If there was a settlement executed between both of you then she can't do any kind of further FIR. So it's advisable for you to first of all write down your grievances and address it to the police station according to your jurisdiction. For more legal assistance I am just a call away.

yes she can do because situation will be the same as it was earlier and other side settlement in such type of cases is not as per the spirit of law as provided therefore settlement in such type of cases is not acknowledged by High Courts as well the only thing which is in your favour that you have a reason and it can be substantiated either by your own direct or circumstantial evidences and every case has lacuna if it is fabricated which goes to the roots of prosecution case.
