Consensual extra-marital relationship is not a criminal offence in India after the Supreme Court judgment decriminalising adultery, though it can have civil consequences in matrimonial proceedings between the spouses. 1 2 Any confession or statement extracted from you at the police station by force, threats or beating is not admissible as evidence, and custodial violence or extortion of money by police is itself illegal and actionable. 3 4 The husband can seek DNA testing only through proper court orders; such tests cannot be forced upon you by police without following due process and your legal rights.

You must understand that admitting the relationship to the husband at this point would be a critical error with severe legal repercussions. The woman has already presented a narrative to the police where you are the harasser. Your confession would provide direct evidence that could be used to support charges against you, such as criminal intimidation, adultery, or worse. In the current legal framework, your admission, coupled with the pregnancy, could be construed as conclusive proof of an offense. Any direct communication with the husband or the woman will only jeopardize your position and should be avoided entirely. Your immediate priority must be to address the illegal actions of the police through proper legal channels. The custodial beating and extortion of money are separate, serious crimes. You need to consult a criminal lawyer without delay to secure your safety, potentially file for anticipatory bail, and formally document the police misconduct. A lawyer can guide you in obtaining a medical examination to record your injuries and preparing a complaint to a judicial magistrate regarding the extortion, which is vital to counter the false case and establish the abuse of power.

It is crucial to understand that once a case is formally registered, the matter falls under the jurisdiction of the Court. At this juncture, private conversations with husband does not matter; what truly matters are your formally recorded statements. Therefore, my immediate advice is to prioritize securing bail and compiling all relevant evidence to substantiate your defense. To provide you with a precise legal strategy, I will need to conduct a detailed analysis of the facts.

From the facts you have shared, it appears that the woman has made false allegations only to protect her marital relationship. If the police called you, assaulted you, or took money from your family, this itself is illegal and can be challenged. Since the relationship was consensual and you ended it on your own, an allegation of harassment has no basis unless she has provided specific dates, acts, or evidence. You can give a written statement to the police clarifying that the relationship was consensual and that you approached the husband only to disclose the truth. You may also mention that the false complaint was filed only after she feared exposure of pregnancy. If the police used force or extorted money, you can file a complaint before higher police authorities or the Magistrate for abuse of power. Ensure you do not contact the woman or her husband further; let everything be communicated legally. Keeping evidence such as chats, call records, and messages will help you defend yourself if any false case is registered against you.
