If the police have already filed the charge-sheet and the accused is absconding, the Court will first take cognizance of the offence and issue process against the accused. If he does not appear despite summons/warrants, the Court may issue Non-Bailable Warrants (NBW) and thereafter initiate proclamation proceedings against the absconding accused as per law. In appropriate cases, attachment of property may also be sought. Once the accused is arrested or appears before the Court, the case will proceed with supply of documents, consideration of charges, framing of charge and thereafter trial. As the complainant/prosecutrix, you may be required to give evidence during trial. You should remain in touch with the Investigating Officer and Public Prosecutor regarding execution of warrants and further proceedings. The exact procedure may vary depending on the stage of the case and orders passed by the concerned Court.

Well, if the Accused is evading arrest, you need to file a case in the concerned High Court against the IO to put all his best efforts along with his team to get him arrested as soon as possible and to expedite the Investigation.
