Being A Victim Can I Demand Compensation In Case Of IPC 308,506

My wife and inlaws tried to kill me for claiming my insurance. They threw me from high rise building from my apartment. I suffered multiple fractures and was in a critical condition, life threatening. My parents spent several lakhs on my treatment and still the treatment is going on. My wife was arrested after one year of absconding. Trial not yet started. She has applied for bail in HC. Can I claim compensation from her against the money spent on treatment? If yes, where and how shall I file the case?

yes you can claim compensation from your wife for whatever losses you have sufferred due to her wrongdoing. you will need to file an application where your case is pending and the court will after haearing your lawyer decide whether you are entitled to be compensated

It is very unfortunate to hear what you have been exposed to. It is important that you strongly oppose the bail application, and raise this contention there as well. Further as per the criminal procedure there are specific provisions that the court may, in appropriate cases award compensation apart from punishment and fine, while passing an order on sentence. However this shall be at the fag end of the trial. In case you have filed a divorce proceedings under Hindu Marriage Act, then as per Sections 24 and 25 you have the right to claim maintenance from your wife, in case you are incapacitated due to the injury and unable to maintain yourself.
