Bank not giving physical possession

25-Jan-2023 (In Criminal Law)
I purchased a house property through E-Auction on 14.12.2017. I paid the full amount of Rs. 59.75 lakhs to the Bank. Bank took the physical possession on 01.03.2019 the house was sealed by the bank. within 4 days somebody occupied the house by illegal trespass. Bank did not take any action. 28.05.2019 bank gave complaint as I made complaint to CPGRAMS Portal. I sent a legal notice to the Bank. As a proof, the Chief manager showed me a CSR copy issued by the police in which it had been stated that the house has been illegally occupied by some unidentified anti-social elements. But in the reply notice sent by the bank to my legal notice, the bank had stated that the house was illegally squatted by karuppana raja and his wife by break open the house. . By my own resources I came to know that with the help of the bank manager only karuppana raja and and his wife occupied the house. Bank is not ready to give my money Rs. 59.75 lakhs nor the house. Please advise.

When some random people falsify documents and illegally occupy the property by coercion (use of force). ... Such an illegal possession can also happen when a tenant refuses to vacate your premises. The most common defense used by tenants is that of adverse possession

You could file a Writ Petition in the respective HC for either refund of the sale consideration along with interest or for enforcing the sale & for obtaining physical possession of the property.
