Bail application in criminal case.
03-Nov-2023 (In Criminal Law)
My brother arrested by Panjab police and charged under sec. 420,120B,66-D on 9 September . my brother name is not even mention in FIR .
FIVE other person also arrested in the same case but they have gotten bail by session court but my brother bail get rejected by session court on 15 October. we have applied for Panjab high court but the application has been in pending status for last 10 days . my brother marriage dated has fixed on 20 November we don't know what we should do can we again appeal in session court for bail with change in the ground of bail application or we should wait for HC date of hearing
You can file a early hearing application before the court in which you will be stating the reason for the early hearing. Once the court is satisfied it will fix the case for early hearing and on the day fixed while your arguments and grounds play the role to furnish the bail. Bail once rejected can be applied at a higher forum. so be strong and seek bail with highly minute and efficient grounds.
though there is no hard and fast rule that if a co-accused gets bail, the other accused also have to get it, yet depending upon the facts of the case and alleged involvement of your brother, you may file your appeal. also the fact that your brother's name was not mentioned in the fir will be helpful.
