Attending to court after receiving summons is mandatory

25-Feb-2023 (In Criminal Law)
Dear sir (s), Me and my wife received court summons by police to attend a FIR case regarding my sister-in-law suicide case registered against her husband 2 years ago. But now practically we don't want to stand against him, as he contains two younger kids. What will happen if we don't attend to the court at the time of hearing., if it is mandatory how to face the lawyer questions in such a way that he will not be punished or jailed. Please advise.

Hi
you should attend the court and since you do not want your brother in law to be punished in the interests of the younger kids, you can deny making any statement to police and say that police took your signatures on blank white papers or alternatively choose to say i have no knowledge of the incident.
You will be declared as a hostile witnesses.
Please remember, even if you choose to hide the truth, there might be other witnesses or other evidences based on which your brother in law MIGHT be convicted as it is case of abetting suicide.
So first and foremost, you and your family should plan for taking care of the children in the event of conviction.
Second TELL THE TRUTH THAT YOU KNOW TO COURT,

Hello,

As you both have been summoned by the court for your appearance, you need to appear, face the trial and fight the case on merits. If you don't appear, arrest warrant can issued against both of you. Engage a good crminal lawyer and proceed further. If you need any assistance you can contact me.
