APPLICATION U/S. 340 OF CRPC READ WITH SECTION 209 OF IPC

We want to submit an application to the court since the petitioner submitted a false claim. The petitioner is stating that respondent was / is living with DV petitioner, which is not. The petitioner is telling other accusation in certain dates but the respondent was at outside of country.nnIn this case, Can a victim file petition U/S. 340 OF CRPC READ WITH SECTION 209 OF IPC. CrPC 340 talks about 195 of Cr.PC. Is this limited to public servants made false claim or any person made false claim?

You are trying to initiate action for perjury and it is a complicated one. False claims made by the petitioner can be disputed in your counter affidavit. Mismatch of dates can be a defence. But you can try to file a petition for perjury under section 340 CrPC read with section 195 CrPC.
