Alternate ways if could not attend court proceedings
18-Oct-2023 (In Criminal Law)
A family member has had a Domestic Violence case been brought against him by his wife. The notice was left outside his mother's house in Goa and was found by her carer in September. My relative no longer lives in India (he has lived abroad for 5 years) so could not attend court in October. We have just seen on the internet that the new court appearance is now in November. Surely someone should have tried to contact him directly. By law should he be given more time to sort this out or can the court just keep setting new dates without informing him?
if he is not residing in India then he can appoint a lawyer or give Power of Attorney to some friend or relative you can attend the court proceeding in place of him. in the mean time a permanent exemption certificate is to be moved from appearance from the court, the case is to be taken seriously
