Alcoholic adict man and women harassment in society
12-Jun-2025 (In Criminal Law)
A man from our society sits in front of our flat's parking area in fully intoxicated state and create caos full day and seat over there by gathering other people as well ,as we get disturbed with noise if we tell him something that too in polite way he starts arguments very badly by coming to our home. Also the one lady that he is sitting she also did very ugly argument with us for no reason we are done and mentally disturbed because of this fact as this has repeated 3 times in last 6 months.
Well, you can lodge a Police Complaint against such people, who in the state of intoxication, have been creating ruckus and chaos, sitting in front of your Flat's Parking Area and get that Complaint converted into a FIR! First approach Society Chairman, if the Chairman does not taking any action, then report to Police!
You have the right to peaceful enjoyment of your property, and repeated nuisance, intoxication, and threatening behavior by any person in the society is a legal concern. Here are the steps you can take:
File a Police Complaint: Immediately file a written complaint at the local police station under Section 268 IPC (Public Nuisance), Section 510 IPC (Misconduct in public by a drunken person), and Section 504 IPC (Intentional insult provoking breach of peace).
Society Committee Complaint: Submit a formal written complaint to your housing society or cooperative committee, requesting disciplinary action or warning against the individual.
NC (Non-Cognizable) Entry: Even if no FIR is filed initially, request the police to make a non-cognizable entry to create a record of the ongoing harassment.
Domestic Trespass: If he enters your home to argue, it amounts to criminal trespass under Section 447 IPC.
Legal Notice: Through an advocate, you may serve a legal notice warning them to refrain from such conduct or face legal action.
Preserve all video/audio evidence or witness statements to support your complaint. Repeated nuisance is actionable — take timely legal steps for your safety and peace.
