Advice regarding False Allegation Criminal Intimidation and Defamation

24-Jul-2026 (In Criminal Law)
In December 2024, while I was serving as Secretary of a housing society, I had an incident with another resident. During the incident, the resident used abusive language and allegedly issued life threat. Incident was captured on the society's CCTV cameras. Based on the incident, I filed a NC with the local police. the same resident submitted a written complaint to the MC alleging that I had threatened his life, and also shared email in society WA group. Looking for advice here.

The CCTV evidence documenting the resident’s abusive language and threats is your strongest defense against the counter-complaint—file a formal response to the MC complaint highlighting this objective corroboration while also requesting copies of all WhatsApp communications to establish a pattern of malicious circulation. However, the critical issue is timing: criminal proceedings move slowly, and false allegations can damage your standing in the society and potentially escalate. I recommend we simultaneously pursue a dual approach—robustly challenge the false accusations in the police investigation while exploring whether the society’s internal dispute resolution or local mediation can defuse tensions and create a documented record of your good conduct. The life threat allegation against you carries serious implications under IPC §506/507, so we need to immediately preserve all evidence (CCTV footage, timestamps, your original NC, society records) and file a detailed supplementary statement with the police. Let’s connect to discuss strategy specific to your situation, including whether to pursue a counter-complaint and how to navigate the society’s response—this is salvageable, but requires immediate, tactical action.

If the allegations against you are false and intended to damage your reputation, you can issue a legal notice and, if necessary, file a criminal defamation complaint and civil claim for damages. Since the incident was captured on CCTV and you had already lodged an N.C., those records can be valuable evidence in your defence.

send a legal notice by advocate and demand the withdrawal of false allegations and an apology. otherwise you can file criminal defamation suit against him under section 173(3) bhartiya nagarik suraksha sanhita. bring the NC copy to file the defamation suit.

Based on the facts stated, if the incident was captured on the society’s CCTV and you have already lodged a Non-Cognizable (NC) complaint immediately after the incident, those records will be important evidence in your favour. Preserve the CCTV footage and obtain a copy if possible, along with the NC acknowledgment. A mere allegation by the other resident does not establish guilt. If the Managing Committee receives a complaint, you may submit a detailed written reply enclosing the CCTV footage (if available), the NC complaint, and any other supporting evidence to rebut the allegations. If the other resident has knowingly made false allegations with the intention to harm your reputation or initiate false criminal proceedings, you may explore appropriate legal remedies, including action for defamation or for giving false information to public authorities, depending upon the facts and the outcome of the police inquiry. If the police call you for inquiry, cooperate fully, provide all evidence in your possession, and avoid any direct confrontation with the complainant. Since the matter appears to involve cross-allegations, the objective evidence, particularly the CCTV footage and contemporaneous records, will carry significant weight. Adv.
