Advice if candidature is been forfeited because of past FIR
08-Oct-2023 (In Criminal Law)
Sir , I am an aspirant of UPSC ,and preparing for the same , 7 years back when I was in my college , the students invoked a Jam on NH 57 besides our college ,for infrastructural grievances ,at that time I was not present at the place of incident but I don't know how my name was placed in the FIR Lodged , in the FIR names of 4 person including me and 50-60 others was charged u/S 143,341,353 after that I contested the case , and was awarded 'not guilty' 'beyond all shadow of reasonable doubts' in 2015 , so now I want to know that is it's disclosure will hinder my selection in UPSC examinations (IAS,IPS,IES) And what judicial measures I can take to forfeit my candidature.
As you said that you have been acquitted from the charges and at present you don't have any case or FIR against you, then you can disclose only if UPSC ask about past criminal records.
In case they ask about your present case then you can take advantage of that column and can't tell about your pase criminal case.
Be very careful and follow the procedure as they said.

In your case as FIR was lodged 7 years back when you were in your college. You have faced the entire trial as per the Indian Criminal Judicial System and finally the court has acquitted you of all the charges leveled on you beyond all reasonable doubts. Now you should have a certified copy of that judgement of acquittal made in your favor by the Hon'ble Court forever and whenever you are facing any competitive examination than you need not to hide that you faced criminal prosecution before any court rather you must reveal this judgement of acquittal. Now you are completely free of any liability and you need not to panic of anything . Now everything is in your favor. I wish you all the best for your future endeavours.
Hi,
Don't cancel your candidature and as you are awarded acquittal there will be no problem in your selection process. if you have given good exam then certainly you will be selected in UPSC exam .
So dont worry as your awarded'not guilty"as you said before.

In case you have been acquitted by the court, in such case the FIR registered against you will not hamper your UPSC as you have been declared Not Guilty by the court which means that you have not committed any offence and the court has acknowledged the same.
