Hi there, if the use intended was private pleasure, then it's not an issue. In India using it in any obscene way/publicly is a crime. However, it's advisable to contact me if any action is taken against use. Till then use it safely and privately.

If a website is prosecuted for selling adult toys, it is unlikely that an individual customer who bought them solely for private use would face legal action, as the prosecution would generally need to prove that the buyer was involved in the business or public circulation of the items.

Under current law, the sale and purchase of adult toys in India is a matter that does not have a direct prohibition under central criminal statutes such as the Indian Penal Code. However, the sale of such products may come under scrutiny under Section 292 of the Indian Penal Code, which criminalizes the sale, distribution, and public exhibition of obscene objects or materials. The responsibility for such sales typically falls on the manufacturer, importer, or the seller—i.e., the owner or the operator of the website—rather than individual customers who make the purchase for private use. Indian courts have differing views on what constitutes obscenity, but generally, private purchase and personal possession of adult toys for private use is not independently prosecuted or penalized. The focus of enforcement, if at all, tends to be on public exhibition, advertisement, or importation and sale intended for mass distribution. If the authorities take action against the website or its operators for alleged violations, it is highly unlikely that customers making purchases for personal use would be prosecuted or subjected to legal action for merely buying these products, unless there is a wider element such as resale, public display, or involvement in illegal importation. In practical terms, enforcement actions have been extremely rare and limited to the sellers or distributors. Therefore, as a customer purchasing adult toys for private and personal use from an online platform, you generally do not face legal risk solely on the basis of purchase. The main legal risk, if any, is faced by the entity engaged in the sale or advertisement of such products. However, it is advisable to refrain from public display or resale, as this could attract the attention of law enforcement.

See there is no explicit law in India that either prohibits or explicitly regulates the sale of sex toys. However, the sale of such products can be said to be regulated primarily by obscenity laws, followed by laws which generally regulate quality of goods and protect consumers’ interests. If there is any legal action contemplated against you, you may put enquiry by means of this app and the necessary legal defence as well as counsel will be provided to you.
