Yes, see Section 173 of CrPC and for new cases 193 of BNSS. If the investigating officer fails to file the chargesheet within 90 days, we will file a bail application on this ground of delay. Is this a special case, like NPDS, POCSO etc.?

When an FIR (First Information Report) is lodged against a person, the police investigate. During investigation, if the offence is bailable, bail is a right; if it is non-bailable, the accused must apply for bail before a Magistrate or Sessions Court. 2. Filing of Charge Sheet After investigation, the police file a charge sheet (also called final report) under Section 173 CrPC before the court. Once the charge sheet is filed, the court takes cognizance of the offence and proceedings move towards trial.

Well, in order to get the Chargesheet filed, Police has to complete its investigation within a time bound manner. If Investigation is not getting completed within a time bound manner, then, you can approach a Court to seek Status Report from Police on Investigation.
