498A Convicted - Appeal - Passport Renewal

Sir/Madam, I am convicted in 498A for 1 year in the lower court.Appeal case is pending in District court.Applied for the passport renewal and it was impounded by passport office as the case is pending. Is it possible to get the passport released on applying the petition in High court and can i travel on job purpose.Kindly advice.Thanks you .

Hi 1) you should try to get your appeal procedure completed fast and obtain your acquittal. 2) Passport authorities are wrong in NOT renewing the passport as obtaining the passport is a birth right. 3) However passport authorities can hand over the passport to the court in which the appeal is pending as it is the District Sessions court which has to grant permission for you to travel abroad during the appeal. 4) Please apply to the District Sessions court for release of passport and permission to travel. In case the District Sessions court rejects your application, you can definitely come to high court and get relief.
