498A chargesheet registered as Misc Case on ecourt

03-Sep-2025 (In Criminal Law)
Can anyone confirm why 85 BNS chargesheet registered as Misc Case instead of Cr. Case and under petitioner it is showing as Complainant as Petitioner and State as Advocate vs SHO Police station as Respondent instead of Accused. Is it positive thing for accused person or not?

When a chargesheet under Section 85 of the BNS is filed, many courts register it first as a “Miscellaneous Case” rather than a Criminal Case. This is mainly due to registry procedure – the court enters the case in the miscellaneous register until cognizance is taken, after which it is renumbered and treated as a criminal trial. It does not mean the case is weak or strong; it is only an administrative step. The cause title showing “Complainant as Petitioner, State as Advocate, SHO/Police Station as Respondent” instead of the accused’s name is also a technical formality. At this stage, the court is primarily examining the police report (chargesheet) and therefore treats the SHO/State as respondent. The accused person’s name will formally appear once the Magistrate takes cognizance and issues process. For the accused, this position is not harmful. In fact, it can be considered slightly positive as the accused is not yet shown as a party before the court. Till the stage of cognizance, the accused is not summoned and no process is formally issued. The case will proceed against the accused only after the court applies its mind and passes an order.

The reason your case is reflected as “Misc. Case” is because at the stage of filing charge-sheet, courts often register it as a miscellaneous proceeding for scrutiny/numbering before converting it into a Regular Criminal Case. That is a procedural aspect and does not affect merits. As for the cause title, it is usually shown as State vs. Accused in police cases. If it is appearing as Complainant vs. SHO/Police Station, it may be due to the software entry or because the matter has been registered on a petition/misc. application and not directly on charge-sheet. This has no substantive benefit or disadvantage to the accused, it is only a clerical/technical issue which can be corrected. The real test is how the case proceeds after cognizance is taken by the Magistrate.

If a case under Section 85 of the Bharatiya Nyaya Sanhita (BNS) is registered as a miscellaneous case with the complainant as petitioner and SHO as respondent, it usually means that no FIR has been filed yet and the complainant is seeking court direction to the police under Section 156(3) CrPC. Since the accused is not yet made a party, no formal criminal proceedings have started. This can be considered relatively positive for the accused at this stage, but there is still a possibility of an FIR or criminal trial being initiated based on the court’s decision.

Hi, this is a procedural technicality and has no bearing on your rights/liabilities as an accused person. There is a small likelihood of a petition having been raised in your case by the complainant for a different prayer. I would need more details to explain as to what the nature of the other petition is.
