Greeting of the day Here are the steps before approaching court for 156(3) 1. Visit Police station if they refuse to register FIR then. 2. Send a written complaint via speed post to DCP. If then also it is registered then 3. Approach court with an application for 156(3) stating all the facts and mentioning the police is not registering your FIR Thank you

You should wait for atleast a week before approaching the court and file an application under section 175(3) under the new law. And also annexe the copy of the complaint along with the application. For more legal assistance I am just a call away.

If the police fail to take action on your complaint within a reasonable time (usually 7–15 days), you may approach the Magistrate under Section 156(3) CrPC. Ensure you keep a copy of your complaint and any reminders sent. Also, try sending a written reminder or RTI to the SHO or higher authorities. The court may then direct police to register the FIR if it finds merit. Attach all documentary proof when filing the application.

There is no statutory period prescribed however, please take note that compliance of Section 154(3) should be done to avoid any complication prior to filling Application for 156(3). If reasonable time has lapsed (over one week). You may approach.

the complaint is valid for 60Days . before that the application under 156(3) can be filed. The validity is not questioned normally if 156(3) has been submitted in the court. So in such cases it is better to file the case at the earliest so thatbthe court also orders the police to take action
