partnership firm -partners namely 'RR' & 'BB', FIRM BECAME NPA in year '2010 partner died 'BB' in year 2014 who was borrower as well gaurantor for his property.now after death of 'bb' collector ordered bank to serve all heirs of 'bb' under natural justice notice for recovery, so bank give all notice to ''SS'' & to other heir namely ' MM' namely, ''MM' HAD already filed huf case saying that 'property is of huf does not own by 'bb', so court restrained 'SS' from any sale/transfer of property and stay order was very well imposed on'ss' and copy of stay order was informed to bank., ''SS'' had place registred will as only owner to bank,, now malafiedly with collusion with bank authority the property was not auctioned but amount settled in 2 parts one part saying OTS another private treaty where only single document singed under private treaty by 'SS'' & ''RR'' who was wife of SS'', ' SS' signed pvt.treaty ,its ,no word written for buyer,other document 'rr''sale to buyer, pvt.treaty bad
