Legal notice from client for not delivering services on time

27-Jun-2023 (In Corporate Law)
Client from Ahmedabad has issued notice stating that the consultation and testing services are priced high and are not provided the complete report on time. Because of which they have failed to fulfil their order from the buyers and suffer 2 crore loss. They are asking to return the amount which was paid within 15 days of receipt of notice. The work is 75% completed and a single test report is pending. Need guidance how to respond..

The appropriate response would stem from the wording of the Contract between the client and you. One must focus on whether time was of the essence in the contract and what factors led to the delay in providing the report.
Once those factors have been determined, a suitable response can be finalized.

If they had agreed with you to procure your services, then they cannot complain that the pricing is high. However if you have not delivered as per the agreement, then you need to file a suitable Reply to their legal notice. Time is of the essence. They may even file a case against you in ahmedabad since they are based there and it will work out expensive for you to travel and engage a lawyer there. Please respond to the notice soon.
