Since there is no express provisions regarding setting up an online lottery business in India, it would require the same procedure as setting up any other business in India. However, since the object of the business is online lottery, it would have to adhere to provisions of Public Gambling Act, 1867, along with provisions of Information and Technology Act, 2000, Companies Act, 2013, Taxation Codes and anti money laundering laws along with foreign exchange laws.

Gambling is a state subject (Schedule VII, List II, Entry 34), therefore, it is for the state governments to allow, prohibit or regulate gambling in their respective states.

As of now, states like Goa, Sikkim and Punjab permit gambling which may include online lottery. These states would require any business, with the objective of setting up online lottery, to comply with the state regulations while applying for a license to operate and maintain online lottery.
