Forgery of my signature on company balance sheets how to proceed
04-Sep-2023 (In Corporate Law)
My signature have been forged on company balance sheets, loan documents in the capacity of director and thereafter director resignation documents by my husband in his private limited company. What is the legal recourse for this? How can I get justice in this?
You can get the specimen copies of your signature duly verified from the handwriting expert and then by submitting the same before the police officer you can get an FIR lodged against the Company and their current directors for doing the above instance.
Dear Client:
This is a punishable offence under Indian Penal Code as well as the Company Act. I suggest that you start with a legal notice. Depending on your husband's response please file for a criminal complaint at a local police station and magistrate court.
I would need more information for further advice 1) what is your current marital status; 2) When did you come to know of the forgery; and 3) Did your husband always do your signatures on your behalf (I mean was it a usual practice?), 4) Are you still a shareholder in RoC records?
Thank you and I look forward to more information on this case.

Firstly forging of a signature is a criminal offence, so I would suggest you to first register a FIR in your nearest police station under section 420, 468, 470, 471 and section 120B of Indian Penal Code.
Secondly, I would suggest you to approach National Company Law Tribunal to reverse the unilateral actions taken by your husband on behalf of you.

In case there are any documents which have been forged, a complaint regarding the same can be registered in the police station or if police is not taking any action, then a petition under section 156(3) Cr.P.C can be filed in court, for registration of FIR under section 468,471.... IPC.
