trademark registration process and time and chances of rejection
19-Feb-2025 (In Trademark & Copyright Law)
I want to register my brand name "Nutri Namah" for my dry fruits company under class 29. There are similar names names like namah organics, nutrifit etc. What are the experts views on the name? What are the chances of my trademark rejection? Should I consider changing the name? Also, is it possible to have "namah" in hindi?
In order to give a proper view on the same, we will need to conduct a public search for your trademark. After the said process only we will be able to give you the proper report whether you should go with the said name or you should consider changing it. Second the process of trademark registration cannot be explained in brief, as it involves alot of steps which is advisable to understand in person.

We first of all conduct an exhaustive risk analysis research report which tells the chances of a successful registration and accordingly we proceed ahead or suggest adding a logo or changing the name. The research report is very crucial to make an informed. Nonetheless, nutri and Namah would constitute words with meanings hence the existing trademarks do not have strong protection and we could still be registered.
Thank you
Considerations for Trademark Registration
1. Trademark Search – Conduct a detailed trademark availability search on the IP India website to check for conflicts with existing marks.
2. Likelihood of Rejection – Since similar names like Namah Organics and Nutrifi exist, objection under Section 11(1) of the Trade Marks Act, 1999 (similarity causing confusion) is possible.
3. Modification Suggestion – Consider modifying the name (e.g., adding a unique prefix or suffix) to improve chances of approval.
4. Namah in Hindi – Yes, Devanagari script can be used for registration, but phonetic similarity may still be a ground for rejection.
5. Legal Action for Rejection – If rejected, you can file a reply to the objection or appeal before the Intellectual Property Appellate Board (IPAB).
