Someone created a fake website by trademark that I own

I have a registered trademark (wordmark) for my brand name in class 44 and have applied for the same in class 10 & 35. I am already running the website with my brand name called since 2014 and registered a pvt limited company since 2022. Recently in March 2024 someone created a fake website with same name but added India after my brand name and are doing business in the same category. I spoke to the owner but they are unwilling to take the website down. How should I handle this?

This is the pure case for infringement and you can send the notice they have to take down immediately failing to which we can move in court where we can ask for compensation for all the damages incurred
