Is it legal to sell previous year question papers online

I want to sell previous year question papers online by making them in pdf format(ebook) for different competative examination .e.g ssc cgl, ssc chcl, po/bank ,etc ,itis legal to sell or illegal.

Hi Sir,

Regarding this query of yours, please note that the you can provide the papers to various exam aspirants but selling them for a consideration/money would attract a civil action against you as you are using someone else's copyrighted property for commercial use. Your use of these previous years question paper would not fall within the premise of fair use and i would advise you to not do so without taking a prior permission or license from the concerned organisation/institute/school/university/college.

This is an important issue which has to be examined keeping in view Copyright Act / Data Protection Laws and the By Laws/ Regulation of University / Examination body. We also need to examine the Judgments of Hon'ble Supreme Court / High Court and the Central & State Information Commission.
Please take a detailed opinion from a competent Law Firm. Please also ask them to examine this in light of Right to Information Act also to get a clear picture and avoid disruption in the business in a future date.

You can write disclaimer and sale compilation of previous years question papers and that is legal to sell. There will not be any copyright violation as those papers are already public no copyright involved in these kind of material

Hi, there are various agencies or publishing houses as well coaching institutions doing the similar work. You have not mentioned whether you run an institution etc. If yes, you can do it and it may not be illegal. Be sure not to sell just question papers but the answers too.
