Can any startup deals with photocopied books run legally

We have a startup named "Bunk n Book" and we provide compiled photocopied books to DU students. Till now we were working part time but now planning to make it a full time business and we are concerned if we will face legal issues due to photocopy thing. We are working same like Rameshwari Photocopy of Delhi University who recently won the case against international publisher in high court. So does that means we can also legally do this business now ??

There are lots of if and but in this case. When you are doing something to make money for yourself in your professional capacity the repurcursion related to that is different while when you do it for making profit and building a business out of the repurcursion is different.
But still your business module is viable and can be done provided you show us the papers related to your business and make it legally correct by availing our services.

Note the fact that the case is pending right now and there are certain compliances to be followed by the Rameshwari as per the directions of the court. However, you can carry your business subject to certain compliances of law. Please get in touch to have a meeting. I've my office in DU NORTH only.

you have your answer given in the query you dont have to worry the business will run like a lorry and if there is a well settled law or judgement in this regard you can carry nothing is illegal unless forbidden by law and prohibitted by law.

I write to you in response to the query shared by you, wherein, you have inquired about legality of your business module. At the onset, I would like to state that the copyright law after Rameshwari Photocopy case has widened the scope of selling photocopy material, but one needs to be very cautious to modify the business module in accordance with the copyright law laid down by the Delhi High Court. In absence of all the relevant fact it will not be possible for me to state any kind of legal opinion.
With respect to Rameshwari case, the Delhi High Court observed that photocopying and creation of course packs to be used in the course of education by students was covered under provisions of the Copyright Act. Holding students’ interests paramount, the ruling concentrated on the aspect of affordability of low-cost textbooks through photocopying.

As you are already aware about the decision by the Delhi High Court in favor of the Rameswari photo copy shop and its conclusion, please note, the decision was on basis of extent of justified purpose. Please keep in mind that the aforesaid defendant was licence holder of DU and the plaintiff had withdrawn the case from further processing. Keeping these points in mind you may go for this business. But, there are chances of objections which may come from different copyright holders in future.
