What to do when hotel has denied the booking of rooms after payment?

We booked a hotel at Panchkula on 18-9-17 for Check in on 30-9-17 and checkout on 1-10-17. The booking was confirmed and the cancellation is fully paid. When we reach the hotel the out rightly denied our booking, and even not ready to provide any kind of help. In middle of the night, I suffered a lot with my family and due to a long weekend other hotels were also jam packed. It forced me to drive all the way to our home at Bareilly. This experience was very shocking and painful to all of us. Now I want to sue them in criminal court and Consumer court as well. 1. Let me know whether it is possible or not? 2. Where should I lodge the FIR at Bareilly UP or at Punchkula, Haryana?

If you've prepaid for your room, it is guaranteed and the hotel must give you the room you paid for, even if you show up late. If the hotel does not have a room for you, then it has breached your contract and must provide you with a reasonable substitute. This means that they may end up having to send you to another hotel, even if it is more expensive, and pay for the transportation - even the phone call to let people know you've switched hotels. You can sue for Breach of Contract or appear before a consumer court. This is not a criminal case. Thus, no FIR is required.
