What action can be taken against online shopping company

If delay in delivery occurs by an online shopping company for paid product then which section/article of consumer protection act shall be applicable. I ordered a product from jabong and i also paid for that product (not cash on delivery). Order was placed on 30th Jun'18 at 9:21am (ORDER ID 180630139054329) and now in tracking status it showing that, The order has been confirmed and it would be delivered by 10 july 2018 expectedly, but till now not shipped. A complaint also raised so If delay in delivery occurs by this online shopping company (jabong) for paid product (not for cash on delivery) then which section/article of consumer protection act shall be applicable for sought.

Dear Sir/Ma'am,

You will have to file a complaint in the District /State /National Consumer Court depending on the price of your product, under Section 12 of the Consumer Protection Act. The additional Sections that you will invoke for filing the Complaint will be for deficiency in service and unfair trade practices i.e. Ss. 2(1)(g), 2(1)(o) and 2(1)(r).

However, before filing the Complaint it is advisable to send Jabong a legal notice seeking adequate and commensurate compensation for the delay in delivery. If Jabong fails to adhere to your demands as specified in your legal notice, you could file a Complaint in the appropriate Consumer Court.

Further, apart from filing the aforementioned Complaint there are other modes of settling this disputes such as Mediation. There are specialised mediation cells to address such online consumer disputes. Be that as it may my advise is to first send a legal notice before any further action is taken. Refer Section 2 (c), Section 2(d), 2(g), 2(r) of Consumer Protection Act. You may file a consumer complaint in the District Consumer Forum in terms of the section 11 & 12 of the Consumer Protection Act.
