I purchased some products from Amazon and since it was damaged wrong I returned it and I got my refund but after some days amazon seller threatening to send him money or product back or he will report against
me to police FIR legal action but product already returned to seller. He said I sent wrong product to him. But they always check before taking back the product.. now I contacted amazon they told me don't worry we will handle this u don't need to involve in this. Now what I have to do ?
Once you have returned the product through Amazon’s official return mechanism and obtained a refund duly processed by Amazon, the transaction stands closed and you have no further liability towards the seller. Every return in such platforms undergoes a quality check before the seller is reimbursed, hence the allegation of sending a “wrong product” has no legal footing against you. The seller’s threats to demand money or to file an FIR amount to criminal intimidation under Bharatiya Nyaya Sanhita, 2023 and carry no enforceable merit because you acted strictly within the contractual framework of Amazon’s Return & Refund Policy. Since Amazon has already confirmed in writing or through customer support that they will handle the matter and that you need not involve yourself further, you should preserve all communications (emails, chat transcripts, refund confirmations, courier tracking slips, etc.) as evidence. If the seller still harasses you or files any frivolous police complaint, you can produce these documents before the police and seek protection, while simultaneously lodging a counter-complaint for harassment, extortion, and misuse of process of law. Importantly, under the Consumer Protection Act, 2019, you as a consumer are shielded against unfair trade practices and wrongful threats once you have followed the platform’s process. Therefore, legally you do not have to pay or return anything further, and the safest course is to let Amazon’s grievance redressal system deal with the seller while you keep a paper trail ready to protect yourself against any false allegations.
Hello,
Please note that for specific legal advice do reach out to an advocate. The following are just observations based on what you have conveyed.
It would be a good idea to retain any and all written communication with Amazon and the seller. Further, it would be wise to insist that all future communication be in writing.
Based on the facts provided the seller seems to intend to intimidate you into paying him. However it is not quite clear what offence he thinks you have committed. Even if he were to suggest cheating or misappropriation of property these would be non-cognizable offences (generally) - i.e. the police will not show up at your door to take you away.
