Sending a friend request alone is not misconduct. If the arbitrator chooses to withdraw, seek a written communication. If no response, parties may jointly terminate mandate and appoint a substitute arbitrator under Section 15 of the Arbitration Act.

Direct or indirect interaction with an arbitrator outside formal proceedings can raise concerns regarding neutrality, even if inadvertent. Since the arbitrator has already expressed an intention to withdraw, it is important to proceed strictly in accordance with the Arbitration and Conciliation Act. In the absence of a formal withdrawal or release letter, the mandate of the arbitrator may still technically subsist. It is advisable to immediately engage legal counsel to issue a formal written communication seeking clarity on the arbitrator’s mandate and, if required, to initiate steps for substitution or termination of mandate before the appropriate court. Timely legal intervention is crucial to avoid future challenges to the arbitral proceedings or the award on grounds of bias or procedural irregularity.
