In this situation first you need to click pictures and videos of whatever damages have been caused to you and you have to hire one architect who will evaluate your damage ..thenceforth you need to file a complaint to the concerned MCD authority and you have to issue a legal notice to this opposite party and then you have to file case at the concerned court which is suit for injunction and damages ..thank you and be in touch

1. send a legal notice to your neighbour directing him to immediately repair the source of seepage and calculate the amount that would be spent on repairing the damage cost to your property and claim this amount as compensation in the notice. 2. file a complaint with the nearest police station and also the municipal corporation. 3. if the neighbour does not repair the seepage and pay you the compensation file a case in court.

If they are not listening to you then you can send them a legal notice and in that notice you can write either repair the walls and give me compensation or face legal action. And if want to go legal then you can always forward a written complaint to the police station of your area. For more legal assistance I am just a call away.

Hi, If your upstairs neighbour has been intimated about the seepage issue and has not addressed it or has deliberately communicated that he would not be doing anything in this regard, it will be wise to inform him about the damage being caused to the building itself which would be a violation of the sub-lease/sale deed/flat buyer agreement for the flat. If the society office bearers are turning a blind eye then it is suggested that more stringent steps be taken to seek legal recourse. Please feel free to contact me for any assistance.
