Leave to defend in a recovery suit of order 37 is to filed with in 10 days from the service to the respondent . If the respondent has not file leave to defend with in 10 days then the court can rule the case in plaintiff favour. Though respondent can move an application explaining reason for delay. Court may or may not consider it or might order to respondent to to give a indemnity bond ( surety) in the court in order to admit his leave of defend .
