This is my first job i sign bond of 2 years of 1 lakh how to exit

03-Aug-2026 (In Civil Law)
I work in Delhi, and this is my first job. I signed a 2-year indemnity bond with a ₹1 lakh compensation clause and completed the 2.5-month training with a ₹30,000 stipend. I want to resign because the work environment is toxic, I am under immense stress, and I'm unable to learn or grow. Can the company recover the bond amount if I resign? Will I have to serve the notice period, and what if I cannot?

Based on the facts stated, an employment bond is not automatically enforceable merely because you signed it. Under Indian law, the employer must prove that the bond amount represents a genuine pre-estimate of the actual loss suffered due to your early exit. A penalty clause of ₹1 lakh cannot be recovered as a matter of right. Since you received only a ₹30,000 stipend during training, the employer would have to justify the claimed loss with evidence. If the work environment is toxic or adversely affecting your health, you may resign by following the procedure in your appointment letter. As regards the notice period, you should ideally serve it. If you are unable to do so, the employer may recover notice pay if your contract permits, but they cannot compel you to continue working. Before resigning, preserve emails, chats, or other evidence regarding the toxic work environment, submit a written resignation professionally, and retain copies of all communications. If the employer initiates recovery proceedings, the enforceability of the bond can be challenged on legal grounds before the appropriate forum.

No, Company can't recover the amount. Law is very clear, unless company hsnt spent that amount on your training, it can't recover the said amount only because contract says so. Notice period can be served. Unless company shows demonstrably that x amount has been spent on your training, only then the bond comes into play.

Yes you can submit your resignation and you are not under any mandatory obligation to serve the notice period as well. I deal with employment/corporate matters so if later the company doesn't pay your salary or you face any harassment due to their actions or take any legal action against you, I am there to help you with this matter, you can reach out to me. I am available in Patiala House Courts India Gate New Delhi. As of now, go and resign happily stating about their toxic environment issues in your resignation letter, all the best. If you face any issue at all, I am a call away. Thanks & regards, Adv Simran Singh Parihar.

Yes, the company may recover the ₹1 lakh bond amount if you resign before completing the agreed 2-year period, depending on the exact terms of the bond. The Supreme Court has upheld such minimum-service bonds in principle. You would also generally be required to serve the contractual notice period or pay notice pay, unless the employer waives it. However, the company cannot force you to continue working. The enforceability of the ₹1 lakh claim depends on the wording of the bond and the circumstances.
