Summons To Defandant order 37 of civil procedure Code 1908
23-May-2025 (In Civil Law)
Summons from Gujarat court to karnataka, police called me to police station regarding summons, summons had name gyanmal jain parat jain, but my name as per aadhaar & pan parat jain, i said to police name miss matches but police insist it's me and instead of giving summons copy to me police has given me executed summons returnable to court copy by police with all the fields left blank, just took my name contact number and date on a paper, next dame mentioned is also wrong
It seems like there's a mix-up with the summons. Here's what you can do:
- *Clarify the Name Discrepancy*: Inform the police and the court about the name mismatch. Provide documents like your Aadhaar card and PAN card to prove your identity.
- *Request Summons Copy*: Ask the police for a copy of the original summons. If they refuse, you can approach the court directly and request a copy.
- *Verify Court Details*: Check the court's details mentioned in the summons, including the case number, date, and next hearing date. If there's an error, inform the court immediately.
- *Appear in Court (if necessary)*: If the court has indeed issued a summons for you, it's best to appear in court on the specified date. You can then clarify the name discrepancy and other issues with the court.
- *Consult a Lawyer*: Consider consulting a lawyer who can help you navigate this situation and ensure your rights are protected.
*Possible Next Steps*:
- *File an Application*: You or your lawyer can file an application in court to clarify the name discrepancy and request a fresh summons with the correct details.
- *Seek Police Cooperation*: If the police are uncooperative, you can escalate the matter to a higher authority, such as the Superintendent of Police (SP) or the District Magistrate (DM).
Keep a record of all interactions with the police and the court, including dates, times, and details of conversations. This will help you track the progress of your case and ensure that your rights are protected.
