Society send us notice to remove car from parking as car is unused

10-Jul-2023 (In Civil Law)
We have been parking our car in society since 30yrs. Car is unused and is not working since past 5yrs. We regularly pay rent for parking to society and car is clean. Parking space is determined by society and is not in agreement of any tenants (old society). We are not spending money on repair as it will be huge cost for repair. Now society's management commitee has send us notice to "remove the car, as its not being used and is in junk condition, else society will take action". Intention to retain our car is if building goes in redevelopment, we shouldn't loose the parking So as per law: 1) Would we have to vacate our parking spot, on society's notice ? 2) If building goes in redevelopment, if person already has parking, does it enable him to get parking in new building (after building is redeveloped) ?

You don’t have to vacate your parking spot as you’re paying parking charges in your monthly maintenance bill. In the event of redevelopment, you will get a car parking space and that will have to be mentioned in your agreement with builder. Also, you will have to immediately place the facts on record and send a reply to the society so that in future, if your parking is disputed then you have a documentary record
