Society member creating nuisance in the premises and abusing others

29-Sep-2025 (In Civil Law)
Respected Sir/Madam, We, residents of a Mumbai society, face persistent issues from a family on the 6th floor. Hygiene is compromised as used adult diapers are left outside their flat. The son misbehaves with members, creates nuisance, and the daughter uses abusive language, threatening residents. Despite warnings and notice, no improvement is seen. Kindly guide us on the next legal/administrative steps to resolve this matter.

You can start by calling for AGM and pass a specific resolution against the actions of said family. On failure to comply, you can send notice and then you can file call for General Body Meeting of all society members of society for expulsion of that specific member for not following AGM resolution. We are society legal consultants.

Document the Incidents Keep a written record of each nuisance or abusive incident: date, time, location, persons involved, and witnesses. If possible, collect evidence like photos, videos, or audio recordings (ensure legality in your area). 2. Review Society Rules Check your society's bylaws or code of conduct-they usually have clauses about maintaining peace, noise limits, and member behavior. Many societies have rules against harassment or disturbance of other residents.
