Second wife legal rights and added name in death certificate is legal

Husband married first wife 1980 and have 2 child after 3 years of marriage life first wife run away due to some mental issue after that husband and his father decided to second marriage but not getting divorce due to first wife mental issue second marriage happened in 1985 second wife having 2 child, both first wife child and second wife child are living same home and second wife take care of both, now husband died, in death certificate second wife name added but first wife child not accepted.

hi alocious here, I can well understand your concern from the query raised, the first wife and her children are are entitled for legal heirship, it is to be noted the children of the second wife as deemed by you are still the legal heirs of the deceased husband, however the second wife is not the legal heir only the children, you can file a objection to the revenue depart
ment and remove her name, thank you, you can

In case of a second wife, she cannot be a legal heir. The children of both wives have equal rights. However, the second wife could be brought on record only after the death of the first wife or divorce decree passed by the competent court.
