Rights of a small-building residents to remove an errant employee

I live in a small building with 4 floors & overall 4 flats in total. The building caretaker, who has been working here for 8 years, has turned rogue to me & one other resident. The 2 of us want him removed but the other 2, who unscrupulously support him in his acts against us are against removing him. They say we need 3 out of 4 votes to remove him. I feel there should be 3 out of 4 votes to agree to continue with him. Whose point is valid, mine or theirs? (The employee in question does not have any appointment letter. He had been just generally employed with verbal agreements.) I'm also considering filing a case of harassment against one of the residents against whom I have sufficient documentary proof. So kindly advise appropriately.
I think you should move before the appropriate authority regarding the matter. You should file a complaint against the employee in order to remove him/her. The two purveiws of both of the parties are correct in this regard.
At the very outset, I would like to say that if you have been harassed by any of the co-residents, you have ample rights to file a legal suit against the said resident. Moreover, if the mentioned caretaker has done any wrongdoing, you should immediately file a criminal case against the said caretaker and add the supporting residents as co-conspirators, before the concerned police.
