Dear Client, Your query lacks information. You didn't disclose the ground or reason behind the rejection of your application for EWS Certificate by the concerned and in the absence of that information which is crucial to justify your claim, any advice or opinion in the matter may be misleading and yield no fruitful outcome even if you file a writ petition seeking a direction from the High Court. Please be informed that EWS Certificates are typically issued to individuals belonging to economically weaker sections of the society if they meet qualifying criterias prescribed by the competent authority. So, first ensure that despite your qualifying criterias, you were denied the EWS Certificate and know the ground of arbitrary rejection of your application for EWS Certificate by the concerned authority, if required, through a RTI Application and consult an Advocate for tailored advice and steps.

If you have submitted all the required documents and satisfy the eligibility criteria for issuance of an EWS Certificate, the authorities are expected to process your application fairly and within a reasonable time. An arbitrary rejection or unexplained delay may be open to judicial review under Article 226 of the Constitution of India. Before approaching the High Court, it is advisable to obtain a copy of the rejection order, if any, and ascertain the specific grounds on which the application has been denied. In many cases, the Court may direct the concerned authority to reconsider the application or pass a reasoned order if the action appears arbitrary, discriminatory, or contrary to law. Since your college admission is stated to be under immediate threat, the matter may involve urgency. The viability of a writ petition and the relief that can be sought would depend upon the documents submitted, the rejection communication, applicable State rules governing EWS certificates, and the admission timelines involved. A detailed examination of the application records and relevant documents would be necessary to assess the merits of the proposed writ petition and the appropriate legal remedy available in your case.
