Remove name from notice of section 126 bnss

What is the process to remove name of family members from the notice issued by SDM in 126 BNSS act. Because notice given in without any criminal background and without any evidence.

As per the new Act, court gives the oppurtunity to accused persons to appear and place his or her stand, based on your submission, court will take cognizance. If you have proof then court will remove the name of accused.
