Can a partnership firm file recovery suit against third party if a individual partner facing criminal charges related firm and without consent of other partner

yes PLEASE in majority case recovery suit in an partnership firms authorised after consultation with other partners of same firms authorised recovery suit is filled with firms but in some cases consent can be relaxed or exempt from the relevant court of appeals thank you sir advocate subodh Ingole

As an advocate, A partnership firm can not unilaterally file a recovery suit based on an individual partner's criminal charges without the consent of other partners and, most importantly, without being a registered firm. The firm must establish its own claim for recovery against the third party.
