Railway Recruitment via Compassionate Grounds how to proceed
19-May-2023 (In Civil Law)
Mr. Raj who works as class 4 employee in railways was married to Jaya and having daughter Shilpa. Due to sudden demise of Raj, his wife Jaya got her husband job in Railways on Compassionate grounds. After few years Jaya was married to Mr. Murthy who also works in Railways. Before Murthy was married to Jaya, he was married to Ramya and she died because of her ill health leaving Murthy with two sons (Anil and Sunil). At present both Murthy and Jaya are working in Railways as Class 3 employees and taking care of their children. In Jan 2017, Jaya was paralyzed and was medically unfit in continuing her job. In this situation will Shilpa (Married) be legally eligible to get her Mother’s (Jaya) job on compassionate grounds in railways. Please note that after Jaya was married to Murthy, her husband name was changed from Raj to Murthy in all railway records. Please also note that, Shilpa’s records are not changed and still has her parents as Raj and Jaya.
Yes, Shilpa can get the job, as shilpa's father is Raj. If there is an option of getting job on medical ground. Even though Jaya got married to Murthy,Shilpa will get the job. May I know your place.
Dear Client,
It is not purely legal query. It depends upon the rules and regulations of Railway Authorities. You must thoroughly go through Standing Orders of Indian Railways. As per Law Whether married woman is entitled to get job of her paralyzed natural mother though her previous husband`s name changed. I think married woman is not entitled to get job of her natural mother. Any way one must go through Standing Orders of Indian Railways.

Shilpa is the natural daughter of Raj and Jaya.
After the marrige of shilpa her parents won't changes. Remarriage of jaya or marital status of shilpadoesn't effects shilpa.
Since shilpa is daughter of Jaya, she is entitled for her mothers job subject to eligibility (age limit etc.,). Because shilpa is the only legal heir of jaya (even murty is alive, he is no need of job)
