Question regarding RTI is transferred to other PIO

13-Aug-2025 (In Civil Law)
I filed a RTI to MCD regarding ATR of offline and online complaints on 12/07/2025 and it's status shows its transferred to other PIO on 22/07/2025 but today is 13/08/2025. Now Should I file my first appeal to FAA? Or wait till 22/08/2025

Under Section 7(1) of the RTI Act, the PIO must provide the information within 30 days from the date the original RTI was received (12/07/2025 in your case), regardless of internal transfers. The transfer to another PIO on 22/07/2025 does not reset the clock — the deadline is still counted from 12/07/2025. That means the 30-day period expired on 11/08/2025, so you are already entitled to file your first appeal to the FAA immediately for “deemed refusal” of information.

Since your RTI was filed on 12/07/2025, the 30-day limit under Section 7(1) of the RTI Act is counted from that date, not from the transfer date. The reply was due by 11/08/2025. As no reply has been received, you are entitled to file your first appeal to the FAA now without waiting till 22/08/2025. In your appeal, mention the delay and attach the RTI and status screenshots as proof.

Based on your query, you have filed an RTI to the MCD regarding ATR for offline and online complaints on 12/07/2025. The status shows that the RTI was transferred to another PIO on 22/07/2025, and as of today (13/08/2025), you have not received any further response. You are seeking advice on whether you should file a first appeal to the FAA or wait until 22/08/2025. As per the provisions of the Right to Information Act, 2005, when an application is transferred to another Public Information Officer (PIO) under Section 6(3), the time limit for providing information is 30 days from the date of receipt of the application by the new PIO. In your case, since the RTI was transferred on 22/07/2025, the new PIO is required to provide the information within 30 days, i.e., by 21/08/2025. If no response is received by the expiry of this period, you are entitled to file a first appeal to the First Appellate Authority (FAA) under Section 19(1) of the RTI Act. Filing the first appeal before completion of 30 days after the transfer may result in rejection or the appeal being kept pending, as the statutory response period has not yet elapsed. Accordingly, my advice is as follows: Please wait until 21/08/2025 for a response from the PIO. If no information is received by this date, you should promptly file your first appeal to the concerned FAA within the stipulated period, explaining the delay and non-receipt of information. Ensure that you attach all relevant documents (RTI application, acknowledgment, transfer status, etc.) with your appeal for proper consideration. If there is any urgency or evidence that the PIO is deliberately delaying the response, you may mention this in your appeal. Otherwise, strictly follow the statutory timelines to strengthen your case for timely disposal. If you need assistance in drafting the first appeal or require any further clarification, please feel free to contact me.

after transfer of your RTI application you have to wait for 30 days thereafter you can make an appeal before FAA. So it is advised you should wait till 22/08/2025. then only you can appeal before FAA. in the meantime you can send a reminder to the PIO, before whom your application is transfered.

you should wait till the date so that the court pronounce the order and order is given. if you are not satisfied by the order then you can go for the first appeal. If you are satisfied with the order then you can relax
