Procedure and steps to special leave petition
10-Jun-2023 (In Civil Law)
Is it required to attend court to counter SLP application before receiving notices from the SC? HC dismissed the case of re-opening arbitration award filed beyond 120 days and aggrieved by the HC order, the petitioner filed an application (SLP) before the SC. What is the procedure and as a respondent what steps need to be taken pls.
Dear,
It is not required to attend the Supreme Court to counter the SLP before receiving notices from court. When the SLP is admitted, the SC will send notices to the respondents for their appearance and for fling counter. The respondent has to appear on the given date along with their counter and file in the court. Regarding advice on the steps to be taken by the respondent in the case, the case papers need to be perused first. Consult an advocate in person and take his/her advice.
