PIO has decided the RTI within 30 days silent on information sought

PIO has decided the RTI application within 30 days but not responded to any information sought by the applicant. PIO order speaks as with reference to your various representations under the Right to information Act 2005, the matter has been presently submitted to the Govt for appropriate action and you will be informed once a decision is taken. As an applicant I have “sought information” and has not made any kind of representation in my RTI Application. Preparing appeal. Your advice please.

You may file a First Appeal under Section 19(1) of the RTI Act before the First Appellate Authority within 30 days, specifically stating that the PIO has failed to provide the information sought and has instead given an evasive and non-speaking reply unrelated to the queries raised in the RTI application. Under the RTI Act, the PIO is required to either furnish the information, deny it with proper exemption grounds under Section 8 or 9, or state that records are unavailable. “Matter is under consideration” is not a valid substitute for statutory compliance, though bureaucracies do seem emotionally attached to that sentence.
